Dani Alves was found not guilty of rape after serving time in prison.

Renowned Brazilian and then Barcelona football player Dani Alves was charged to court in February 2023 for sexually assaulting a woman in a night club bathroom in Barcelona in December 2022.

The woman, who was a model claimed Dani Alves and his friends bought champagne for herself and two of her friends. Then, forced her into the bathroom grabbed, slapped, insulted and threw her on the floor and violently raped her. 

Afterwards, she left the bathroom weeping uncontrollably as his actions according to her caused her “anguish and terror.” Because she didn’t know it was the bathroom he was luring her to initially and despite her attempts to leave, he violently had his way with her on the floor.

Dani Alves wife too claimed he was drunk that night so perhaps had no idea what he was doing. 

Regardless, the alleged victim demanded compensation of €150,000.00 (regardless of who wins the case), and her lawyers wanted 9yrs imprisonment while herself (victim) wanted 12yrs imprisonment.

Although, Dani Alves pleaded not guilty, stating the act was mutual, the game was rigged against him. Dani Alves told the court that they both discussed, went into the bathroom and had intercourse. And if she didn’t want she’d have easily left, as they both had fun which she fully consented to, however, the 23yr old model, objected, saying she never gave consent. Dani Alves was later sentenced to four years imprisonment, at Brians 2 Prison.

Sponsors like Puma cut ties with him. Law suits piled up against him including a $2.2 million from Pumas UNAM which initially asked him to pay $5 million for hurting the club with his sexual harassment case. His marriage to Joana Cruz crumbled. One month after he was falsely convicted, his wife divorced him, because she felt hurt, abandoned, and the whole rape case was affecting her mental health.

Dani Alves who was once worth $60million lost everything.

Alves had been held in pretrial detention from February 2023 to April 2024 before he was released on bail of €1 million.

Dani Alves appealed the case and won on March 28th, 2025. The court didn’t outrightly declare him innocent, but the court ruled the conviction because it was considered unsafe. The appeal court stated that the evidence provided contained gaps, inconsistencies, and contradiction. It was said the testimony of the accuser differed from the evidence presented in a video footage which confirmed Dani Alves’ proof of innocence. 

This is because in the three day trial, Dani Alves presented fresh video evidences. Apparently, the footage showed that, the girl went into the bathroom with him happily, came out herself and went back in again herself. And when she came out finally, she wasn’t weeping uncontrollably like she claimed, or looking tensed. She went and continued partying. So, since her story was inconsistent, the four judges ruled unanimously favoring Alves’ appeal.

State prosecutors have announced plans to appeal the acquittal to Spain’s Supreme Court. Meanwhile, the decision restores Alves’ presumption of innocence and lifts travel restrictions and compensation obligations tied to the original verdict.
