Former governor of Rivers State, Mr. Peter Odili, according to a report by the Guardian, had obtained an order of injunction prohibiting the Ecomonic Financial Crimes Commission (EFCC) from investigating the finances of his tenure.

Mr. Odili is said to have obtained the order that shielded him from being investigated, arrested, or prosecuted from the Rivers State High Court in 2007, during which he was concluding his eight-year tenure as a governor of the oil-rich state from 1999 to 2007.

Since 2008, the EFCC has contested that order of injunction, seeking leave from the Court of Appeal in order to be able to probe the ex-governor’s administration.

The report says the EFCC were granted the leave later in 2018 by the Appeal Court.

However, this decision by the Appeal Court did not go unchallenged as the then Attorney General of Rivers State, and Speaker of the state’s House of Assembly filed a different petition to the Supreme Court to reverse the Appeal Court’s decision.

But on Monday, March 10, 2025, a five-member panel of judges led by Justice John Okoro dismissed the petition of the Attorney General and State House Speaker, saying such appeal is not the type the apex court hears, that they should take it back to the Appeal Court.

The appeal was withdrawn by the petitioners’ lawyer without objection from the EFCC’s lawyers, with Justice Okoro dismissing it.

His words: “The appeal is dismissed, having been withdrawn without any objection.”
